<p>Apple is responding to Motorola with a first salvo, a suit over 6 multi-touch patents in something that was expected even by Motorola that early this month suit Apple over mobile phone and service related to the iPhone, Motorola weeks laters filed a motion to dismiss some Apple&#8217;s patents used by Apple to suit HTC. Apple claimed that Motorola&#8217;s Droid, Droid 2, Droid X, Cliq, Cliq XT, BackFlip, Devour A555, Devour i1, and Charm infringe on its patents.</p>
<p>Now Apple is doing what it does best suing Motorola, Apple took its time and evaluated which patents are the most suitable for this fight, but going against Motorola and HTC puts more pressure on other Android partners, the question is who&#8217;s next?</p>
<p>The following information pertains to six granted patents listed in Apple&#8217;s two distinct lawsuits. </p>
<p>In the First Case (0661)</p>
<p>One: Apple, Inc patent titled: Ellipse Fitting for Multi-Touch Surfaces: Patent Abstract: Apparatus and methods are disclosed for simultaneously tracking multiple finger and palm contacts as hands approach, touch, and slide across a proximity-sensing, multi-touch surface. Identification and classification of intuitive hand configurations and motions enables unprecedented integration of typing, resting, pointing, scrolling, 3D manipulation, and handwriting into a versatile, ergonomic computer input device.</p>
<p>Two: Apple, Inc patent titled: Multipoint Touchscreen: Patent Abstract: A touch panel having a transparent capacitive sensing medium configured to detect multiple touches or near touches that occur at the same time and at distinct locations in the plane of the touch panel and to produce distinct signals representative of the location of the touches on the plane of the touch panel for each of the multiple touches is disclosed.</p>
<p>Three: Taligent, Inc patent titled: Object-Oriented System Locator System: Patent Abstract: A method and system for adding system components (documents, tools, fonts, libraries, etc.) to a computer system without running an installation program. A location framework is employed to locate system components whose properties match those specified in search criteria. The framework receives notification from the system when system components whose properties match the search criteria are added to or removed from the system.</p>
<p>In the Second Case (0662)</p>
<p>Four: Apple, Inc, patent titled: Touch Screen Device, Method, and Graphical User Interface for Determining Commands by Applying Heuristics: Apple&#8217;s invention generally relates to electronic devices with touch screen displays, and more particularly, to electronic devices that apply heuristics to detected user gestures on a touch screen display to determine commands.</p>
<p>Five: Apple Computer, Inc. patent titled: Method and Apparatus for Displaying and Accessing Control and Status Information in a Computer System: Apple&#8217;s invention generally relates to the field of computer systems; particularly, the present invention relates to displaying a status and control function bar or window to enable access of user selected indicia to a computer system user.</p>
<p>Six: Apple Computer, Inc. patent titled: Support for Custom User-Interaction Elements in a Graphical, Event-Driven Computer System: Apple&#8217;s invention relates to graphical, event-driven computer systems, more particularly to custom interactive user-interaction elements in a computer system having a window-based graphical user interface.</p>

<p>Apple has been soooo slow in China that even Lenovo&#8217;s head Liu Chuanzhi believes so, Apple is missing a big opportunity in China and is taking a ultra passive stance when the indications point to a more aggressive response, but I really don&#8217;t believe Apple was so slow until yesterday news about people buying all the iphones they can, jumping and running with dozen of iphones to satisfy the grey market, this situation forced Apple to close the Beijing Apple Store, but the stellar introduction of the <b>iPhone</b> in China&#8217; Unicorn that received 200,000 pre-orders but could deliver 100,000.</p>
<p>There are two facts here:<br />
1) If there&#8217;s a need (like desperation) for the <b>iPhone</b> in China that people would like to buy more than 20 iPhones if permitted, why not inject more devices and keep the market with enough units to meet the high demand, maybe Apple was so cautious that it&#8217;s hurting itself and at the same time is helping grow the grey market, a market that has shown that the demand is even higher when they approached people from other countries in order to buy their iPhones, an indication for Apple that the chinese market was more than ready to move million of iphones but ended up supplied with just less than expected.</p>
<p>2) <b>Android</b>? What <b>Android</b>? Apple Store Beijing incident could be taken as the most important indication of who is really driving the market, this time is not about perception, it is about units sold and people were like crazy, like a Black Friday in the U. S., buying all the <b>iPhone</b> they can is something you won&#8217;t and haven&#8217;t seen with any Samsung, Motorola or HTC <b>Android</b> based phones and Apple didn&#8217;t take the whole advantage with enough units available to supply the market.</p>
<p>This is a bad calculation, poor anticipation or is Apple applying a myopic strategy that guarantee a complete sold out, but left thousands of new customers waiting for the grey market to satisfy their need? I would go for the massive sell out, I would sell all the iPhone any given people can buy or set the unit limit to a higher level (40, 80) per buyer.</p>
<p>The iPhone Grey market is the reason of a poor planification/anticipation or acknowledge of how any given market will react to any product, Apple should knew that and opted for a more convervative implementation of something that was supposed to be bigger than expected, closing the Beijing Apple Store and force buyers to the Grey Market.</p>

<p>Apple’s iPhone did very good in the U.S. lately. In fact the iPhone 3G did so well in sales that it managed to grab that number one position held by Motorola’s RAZR. Motorola fell on the second place and it’s followd by the BlackBerry Curve, the Rumor and the V2, both from LG.</p>
